By registering for and participating in the Gaming Cultural Hackathon ("the Hackathon"), you ("the Participant") agree to the following terms.
1. About the Hackathon
The Gaming Cultural Hackathon is part of Museums & Gaming Connected, a research and collaboration project exploring how museums and schools can connect with younger audiences through gaming, with a focus on Roblox as a platform for cultural and educational engagement. During the Hackathon, participants work individually or in teams to develop concepts and prototypes in response to design challenges based on real museum contexts.
2. Eligibility
The Hackathon is open to students enrolled at a participating university or educational institution. By registering, the Participant confirms that they are authorized to take part and that their participation does not conflict with any obligations to their institution or third parties.
3. Use of Museum Materials
During the Hackathon, Participants may receive information, references, or materials provided by participating museums as input for their concepts. These materials are shared solely for use within the Hackathon and related project activities, and may not be redistributed, republished, or used for purposes outside the Project without written permission.
4. Intellectual Property of Submitted Concepts
By submitting a concept, prototype, presentation, or any other work developed during the Hackathon ("the Submission") to the Hackathon, the Participant agrees that:
Ownership. All intellectual property rights in the Submission, including but not limited to copyright, design rights, and related rights, are transferred to and owned by Broken Egg upon submission.
Consideration. The Participant acknowledges that the opportunity to participate in the Hackathon, the educational and professional experience gained, the exposure to museums and industry partners, and eligibility for the Hackathon awards constitute fair consideration for this transfer.
Moral rights and credit. The Participant will always be credited as the original creator of their Submission wherever it is published, showcased, or referenced. To the extent permitted by law, the Participant waives any moral rights that would prevent Broken Egg from using, adapting, publishing, or further developing the Submission, while retaining the right to be identified as the creator.
Portfolio use. The Participant retains the right to include the Submission in their personal educational portfolio, CV, and academic work, and to reference their participation in the Hackathon for non-commercial, personal, and educational purposes.
Warranty. The Participant confirms that the Submission is their own original work (or the original work of their team), does not infringe any third-party rights, and does not contain copyrighted material, trademarks, or assets they are not authorized to use.
5. Awards
The top three (3) Submissions will receive an award, as announced in the Hackathon communication. The selection of winning Submissions is made by a jury appointed by Broken Egg and Xolbor, and the jury's decision is final. Receiving an award does not create any employment, service, or additional contractual relationship between the Participant and Broken Egg.
6. Publication and Promotion
Broken Egg and Xolbor may publish, showcase, and promote Submissions and the results of the Hackathon as part of the Project, including in the Gaming Playbook, project reports, presentations, social media, press communications, and future portfolio references. The Participant's name and affiliation may be mentioned in this context. The Participant's likeness (photos, video) taken during Hackathon events may also be used for these purposes.
7. Team Submissions
If the Submission is developed by a team, each team member individually agrees to these terms, and the team collectively confirms that all members have contributed to the work and accept the IP transfer described in Section 4.
8. Personal Data
Personal data provided during registration is processed in accordance with applicable privacy laws and used only for the organization and communication of the Hackathon and the Project. Data will not be shared with third parties outside the Project without the Participant's consent.
9. Code of Conduct
Participants agree to engage respectfully with other participants, organizers, museum representatives, and jury members. Broken Egg reserves the right to disqualify any Participant whose behavior is disrespectful, harmful, or disruptive to the Hackathon.
10. Liability
Broken Egg and Xolbor organize the Hackathon with care but cannot be held liable for any indirect consequences arising from participation, including loss of data, equipment issues, or travel-related matters.
11. Governing Law
These terms are governed by the laws of the Netherlands. Any disputes will be resolved in good faith between the parties before pursuing other means.
12. Agreement
By registering for the Hackathon and submitting a concept, the Participant confirms that they have read, understood, and agreed to these Terms of Participation.
